These Terms of Service ("Terms") govern your use of the website and online services operated by StaySouth Vacation Homes LLC ("StaySouth," "we," "our," or "us").

StaySouth is an independently owned and operated Casago franchisee.

By accessing or using our website, submitting an inquiry, or using services made available through the website, you agree to these Terms.

If you do not agree with these Terms, you should not use the website.

1. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding agreement to make a reservation through our website.

Additional minimum-age requirements may apply to individual properties and will be disclosed as part of the applicable reservation terms.

2. PURPOSE OF THE WEBSITE

Our website may allow users to:

• Search vacation rental properties
• View property information
• Request information
• Make or request reservations
• Communicate with StaySouth
• Inquire about property management services
• Access information relating to properties we manage
• Access other services we may make available from time to time

We may change, suspend, or discontinue portions of the website at any time.

3. STAYSOUTH AND CASAGO

StaySouth Vacation Homes LLC is an independently owned and operated Casago franchisee.

Certain properties managed by StaySouth may also be marketed, displayed, distributed, or booked through Casago websites, systems, technology, distribution channels, or affiliated services.

Unless otherwise expressly stated, property management services provided by StaySouth and rental agreements involving properties managed by StaySouth are provided by or entered into with StaySouth Vacation Homes LLC, not Casago Holdings LLC or Casago International LLC.

Separate terms established by Casago may apply when you use Casago-operated websites or services.

4. RESERVATIONS AND TRANSACTION-SPECIFIC TERMS

A reservation may be subject to additional agreements, rules, policies, disclosures, and conditions ("Reservation Terms").

Reservation Terms may include:

• Rental rates
• Taxes
• Fees
• Deposits
• Payment schedules
• Cancellation policies
• Refund policies
• Security deposits
• Damage policies
• Occupancy limits
• Minimum-age requirements
• Pet policies
• Check-in and check-out requirements
• Property rules
• Community or association requirements

You are responsible for reviewing applicable Reservation Terms before completing your reservation.

If these general website Terms conflict with specific written Reservation Terms applicable to your reservation, the applicable Reservation Terms will control with respect to that reservation.

5. PRICING, FEES, AND TAXES

We attempt to accurately display pricing, fees, taxes, and other charges associated with reservations.

The amounts applicable to your transaction will be disclosed during the reservation process or in your Reservation Terms.

You agree to pay all charges you authorize in connection with your reservation.

Rates, availability, taxes, and fees may change until a reservation is confirmed.

6. PAYMENT AUTHORIZATION

By providing a payment method, you represent that you are authorized to use that payment method and authorize StaySouth and/or its payment-processing providers to charge amounts properly due under your reservation or other applicable agreement.

Payments may be processed through third-party payment processors.

The payment processor may have separate terms and privacy policies governing its services.

7. CANCELLATIONS AND REFUNDS

Cancellation and refund rights vary by reservation.

The cancellation policy presented during booking or contained in your applicable Reservation Terms controls.

Unless specifically provided otherwise in the applicable Reservation Terms or required by law, cancellation, modification, refund, and credit requests are subject to the terms applicable to the reservation at the time it was made.

8. PROPERTY INFORMATION

We attempt to provide accurate property descriptions, photographs, rates, amenities, availability, and other information.

However, information may occasionally contain errors or change due to circumstances outside our control.

Amenities may become unavailable because of maintenance, repair, weather, building restrictions, utility interruptions, community rules, owner changes, or other circumstances.

When we discover a material issue affecting a confirmed reservation, we will address it in accordance with the applicable Reservation Terms and applicable law.

9. GUEST RESPONSIBILITIES

Guests are responsible for:

• Providing accurate information
• Complying with occupancy limits
• Following property rules
• Following building, resort, condominium, or homeowners association rules
• Respecting neighboring properties and residents
• Avoiding unlawful activity
• Using the property responsibly
• Following check-in and check-out procedures
• Paying authorized charges
• Reporting material property issues in a timely manner

Guests may be responsible for damages, unauthorized charges, fines, penalties, or other amounts as provided in their applicable Reservation Terms.

10. PROHIBITED USE OF THE WEBSITE

You may not use our website to:

• Violate any applicable law
• Commit or attempt fraud
• Make a reservation using false information
• Use a payment method without authorization
• Interfere with the operation or security of the website
• Introduce malware, viruses, or malicious code

• You have the right to submit the content
• The content does not violate applicable law
• The content does not infringe another person's rights

We do not guarantee that our website will always be uninterrupted, error-free, completely secure, or available.

We reserve the right to correct errors and address transactions affected by material errors as permitted by applicable law and the applicable Reservation Terms.

16. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

STAYSOUTH DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN AN APPLICABLE WRITTEN AGREEMENT, INCLUDING IMPLIED WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

Nothing in these Terms eliminates any warranty or right that cannot legally be waived.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STAYSOUTH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE.

Any liability arising from a particular reservation or property stay will also be subject to the applicable Reservation Terms and any rights or limitations imposed by applicable law.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

18. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless StaySouth Vacation Homes LLC and its officers, employees, and agents from third-party claims, liabilities, damages, costs, and expenses arising from:

• Your material violation of these Terms
• Your unlawful use of the website
• Your violation of another person's legal rights

This provision does not require indemnification for claims resulting solely from StaySouth's own unlawful conduct where such indemnification is prohibited by law.

23. ENTIRE AGREEMENT

These Terms govern general use of the StaySouth website.

They do not replace Reservation Terms, property-management agreements, owner agreements, or other separate contracts entered into between StaySouth and a guest, owner, vendor, or other party.
